These Terms & Conditions (“Terms”) govern your access to and use of the website www.bewellasia.co and any associated applications (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.
1. Our Contract with You
1.1 These Terms apply to any order placed through the Platform and accepted by the Company.
1.2 The Company may update these Terms from time to time. The version in force at the time an order is placed shall apply.
1.3 Please read these Terms carefully before placing an order. Certain provisions limit the Company’s liability.
1.4 If you need to contact the Company regarding an order, please refer to Section 15.
2. Definitions
“Platform” means the online platform operated under the registered trademark bewellasia.co, including the website www.bewellasia.co and any associated applications.
“Product” means any test, service, package, or voucher displayed on the Platform.
“Order” means a request submitted by you through the Platform for Products.
“Service Providers” means independent, licensed third-party laboratories, clinics, physicians, or healthcare professionals.
“Services” means laboratory, diagnostic, or healthcare-related services performed exclusively by Service Providers.
“Company” means NFNT Co., Ltd., registered in Thailand.
“You / Your” means the individual accessing or using the Platform or Services.
3. Agency Relationship
The Platform bewellasia.co operates solely as an online intermediary and acts only as an agent between users and independent, licensed third-party Service Providers.
The Company does not provide medical, diagnostic, or laboratory services, does not operate a medical facility, and does not employ healthcare professionals for the purpose of providing medical services.
All sample collection, laboratory testing, medical assessments, and result interpretations are carried out exclusively by Service Providers, who are independently responsible for compliance with applicable Thai laws, regulations, and professional standards.
4. Placing an Order
4.1 Submission of an Order does not constitute acceptance. A binding contract is formed only once payment has been accepted and an order confirmation has been issued by the Company.
4.2 You are responsible for ensuring that all information provided in connection with an Order is accurate and complete.
4.3 The Company reserves the right to reject or cancel any Order if fulfillment is not possible.
5. Changes, Cancellations, and Refunds
5.1 Services purchased through the Platform are eligible for a full refund within seven (7) days from the date of purchase, provided that the service has not been redeemed, whether in part or in full.
5.2 A service is considered redeemed once any of the following has occurred:
(a) the laboratory order has been presented at a partner laboratory;
(b) sample collection has started; or
(c) a doctor consultation is cancelled less than forty-eight (48) hours before the scheduled consultation time.
5.3 No refunds are available for services that have been partially or fully redeemed, or once sample collection or laboratory processing has begun.
5.4 If an incorrect or incomplete home collection address is provided and the Service Provider attends that address, the home collection fee is non-refundable. Rescheduling may require an additional home collection fee.
5.5 Approved refunds will be issued to the original payment method and are typically processed within seven (7) to fourteen (14) business days, depending on the payment provider.
5.6 Refunds are governed by the bewellasia.co Refund Policy, which forms an integral part of these Terms. In the event of any inconsistency, the Refund Policy shall prevail.
6. Pricing and Payments
6.1 Prices for Products are displayed on the Platform and may change at any time prior to acceptance of an Order.
6.2 Payments made through the Platform are collected by the Company as agent on behalf of the relevant Service Providers.
6.3 The Company’s responsibility in relation to payment is limited to facilitating payment collection and remittance in accordance with agreed arrangements with Service Providers.
7. Delivery of Vouchers and Results
7.1 The Company will use reasonable efforts to facilitate delivery of vouchers and test results but does not guarantee timelines.
7.2 Delays caused by Service Providers or external factors are outside the Company’s control.
8. Service Standards
8.1 Service Providers are solely responsible for ensuring that all Services are performed in licensed facilities and by appropriately qualified professionals.
9. No Medical Advice
Any information, explanations, summaries, or guidance made available through the Platform, including content related to test results, is provided for general informational and wellness purposes only and does not constitute medical advice, diagnosis, or treatment.
You must consult a licensed physician or qualified healthcare professional before making any medical decisions.
10. Limitation of Liability
10.1 The Company shall not be liable for clinical outcomes, diagnoses, or medical decisions made by Service Providers.
10.2 To the maximum extent permitted by law, the Company’s liability is limited to refunding amounts paid for Services that cannot be delivered.
11. Events Outside Our Control
The Company shall not be liable for any failure or delay caused by events beyond its reasonable control.
12. Health Data and Privacy
By using the Platform and Services, you explicitly consent to the collection, use, disclosure, and processing of your personal and health data in accordance with Thailand’s Personal Data Protection Act (PDPA) and the Company’s Privacy Policy, including disclosure to Service Providers solely for the purpose of delivering the Services.
13. No Affiliation
bewellasia.co operates as an independent digital health services platform. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Be Well Medical Clinic, bewell.co.th, or any similarly named medical clinic, hospital, or healthcare provider.
Any similarity in name is coincidental and does not imply any partnership, association, endorsement, or commercial relationship.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Thailand and subject to the exclusive jurisdiction of the Thai courts.
